Introduction

Welcome to our website (“Company”, “we”, “our”, “us”)!

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at akvilatravel.com (together or individually “Service”) operated by Akvila Travel Company.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

Only when We will receive full payment from the consumer, will there exist a contract between both parties. This contract is governed by Greek Law and jurisdiction. We reserve the right to decline any reservation.

In these General Terms and Conditions are the following definitions apply:

Product: Any tour, ticket and/or service, offered for sale by Akvila Travel Company on behalf of the provider of such tour, ticket and/or service;

Consumer: He/she who purchases (or wants to purchase) a product via akvilatravel.com;

Provider: The provider (or his/her representative other than Akvila Travel) of a product offered for sale via akvilatravel.com.

Purchases

Services purchases can be made via akvilatravel.com website. A purchase only becomes valid after full payment.

Product purchases can only be made by persons older than eighteen (18) years.

The same day services purchase not possible.

Payments

 All tours must be paid upon confirmation of the product purchase.

 Payments should always be made to Akvila Travel Company via the payment methods provided by akvilatravel.com website.

The date that a payment is received by Akvila Travel is considered to be the date of payment.

In the event a payment due is not received in time, we reserve the right to cancel the purchase.

Cancellation/refund and changes

Cancellation up to 3 calendar days prior to tour: you will receive full refund

Cancellation less than 3 calendar days: you will be charged a 100% cancellation fee.

You can request to amend or change the dates of an existing booking more than 3 days ahead of your confirmed travel date, no charge.

We (as intermediary) can cancel or alter the purchase agreement between provider and consumer at any time in the event of:

• “Force Majeure” means and includes war, or warlike conditions, terrorist activities, breakdown, fire, perils of the seas, storms, “foundering” or other weather related occurrences, earthquake, flood, vandalism, destructive acts of God, or of government, political disturbances, legislative enactments, embargo, riot, civil commotion, regulatory interference, strikes, lockouts, shortages, industrial and labor disputes and all other causes beyond the reasonable control of us.

• cancellation or change by the provider.If we cancel the tour for any above reasons, then a full refund will be given or it will be possible to reschedule your booking for another day, depending on availability.

We  reserves the right at its sole option and discretion and that of the providers, without liability for damages or refund of any kind, to alter or deviate from the advertised or ordinary itinerary, either this is caused by weather conditions, “Force Majeure” or other extraordinary conditions. Such does not entitle consumers for any claims or refunds.

Voucher

After confirmation of purchase and payment for a product, consumer will receive a unique voucher for each product.

Consumer must provide this unique voucher to the provider.

E-voucher or printed copy are accepted by provider.

Liability

We act as an intermediary between provider and consumer and therefore cannot be held liable in the event a provider and/or consumer should fail to meet their obligations under the purchase agreement.

 We shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services.

 We is not liable for bodily injury, accidental death or property damage or theft as a result of (but not limited to):

falling, physical exertion for which a guest is not prepared; forces of nature; travel by auto, boat or other conveyance; foot or other forms of active or adventure travel; consumption of alcoholic beverages; civil unrest; terrorism; a breakdown of equipment; high altitude; lack of or limited access to medical attention in remote locations; and the adequacy of medical attention once provided.

We is not liable for additional expenses a guest may incur as a result of a late start and/or late return due to natural disasters, weather, traffic, illness of a guide or other guest while en-route or any other delays due to circumstances beyond our control.

We reserve the right to make a route modifications as necessary to improve the trip’s quality or to accommodate weather and the comfort and well-being of guests.
